Lantern Light Productions
Trade Customs (subject to change without notice)

1. Orders and Schedules: Lantern Light Productions shall not incur any liability or penalty for delays due to labor disputes, fires, accidents, wars, floods, or other causes beyond the control of our organization.

Estimates: An estimate is an offer to perform work based upon information and specifications supplied by the client. Estimates not accepted within thirty (30) days are subject to review.  Estimates may be revised if the information and specifications for the job change.

Cancellations/Delay/Work in Process: If the client cancels an order or withdraws material while work is in process prior to completion of the end product, Lantern Light Productions assumes no responsibility for the completion of the work and is entitled to compensations for all work whether or not it is completed at the time of cancellation or withdrawal. If work on a order is delayed by the client, a charge may be made by Lantern Light Productions to compensate for additional costs caused by the delay.

Alterations/Responsibility: No alterations to original material supplied will be made unless specifically ordered and marked on a layout proof.  Lantern Light Productions is not responsible for the quality or accuracy of the original material supplied by the client or client’s agency.  Neither is Lantern Light Productions liable for any fixed, stipulated amount as “liquidated damages” should damage or loss occurred to any original material furnished by the client. 

5. Examination Responsibility
: It is the responsibility of the client or his agent to examine proofs, negatives and positives or other materials upon receipt to determine that all specifications have been met. Lantern Light Productions will honor no claims unless made within three (3) days of the client’s receipt of the end product. In case of disputes regarding an end product, the sole responsibility of Lantern Light Productions is to correct or replace such end product promptly.
6. Ownership
: Each end product produced by Lantern Light Productions is the property of the client who ordered the product, unless specified in writing.  All intermediate materials, including electronic data, drawings, artwork, film negatives and positives, separations, engravings, platter plates, and molds originated by Lantern Light Productions and used in the production of end products are the property of Lantern Light Productions unless otherwise specifically agreed to in writing.
7. Storage
: Lantern Light Productions shall retain intermediate materials until the client has accepted the related end product.  If requested by the client, intermediate materials shall be stored for an additional period of up to one year, for which a charge can be made. Reasonable care shall be taken by Lantern Light Productions to provide an appropriate storage environment.  Integrity of stored electronic data cannot be guaranteed due to technological limitations of media and devices available. 
8. Indemnification
: The client shall indemnify and hold harmless Lantern Light Productions from any and all cost, expense and damages on account of any an all manner of claims, demands, actions, and proceedings that may be instituted against Lantern Light Productions on grounds alleging the job violates any copyright or proprietary right of nay person, or that it contains any matter that is libelous or scandalous, or invades any person’s right to privacy or other personal rights.  At the client’s expense, the client shall agree to defend promptly and continue the defense of any such claim, demand, action or proceeding that bay be brought against Lantern Light Productions provided that Lantern Light Productions shall promptly notify the client with respect thereto and provided further that Lantern Light Productions shall give the client such reasonable time as the exigencies of the situation may permit in which to undertake and continue the defense thereof.
9. Payment
: Payment: accompanying an advertising order or payment of an account must be provided in the form of a U.S. Funds check drawn on a U.S. Bank. Personal or company checks, bank money orders, cashier's checks or similar instruments drawn on foreign banks are not acceptable. 50% of Estimates are due at the acceptance of job. The remainder of balance is due midway of assigned expected project due date. CHECKS ARE MADE PAYABLE TO LANTERN LIGHT PRODUCTIONS.
10. Authorized Signature
: In making this application, I hereby acknowledge that I have read, understand, and signed off on the attached Trade Customs and attachment _____ for Lantern Light Productions and hereby agree to be bound by and comply with the Trade Customs and attachment_____. I further acknowledge that failure to abide by the Trade Customs and attachment ____ may result in full compensation to Lantern Light Productions.
